Questions

The things employers ask first.

Do I have to submit an Employment Equity report?

If you employ 50 or more people, yes, regardless of turnover. Since January 2025 the turnover test no longer applies and headcount alone decides. Organs of state report whatever their size. If you crossed 50 employees at any point during the reporting period you are designated for that cycle, even if headcount has since dropped.

When are the 2026 deadlines?

The season opened on 1 September 2026. Manual submissions close 1 October 2026. Online submissions through the Department's portal close at midnight on 15 January 2027.

So the real deadline is 15 January?

On paper, yes. In practice, no. Practitioners finalise before 1 December, because the people who have to sign a submission are on leave from mid December into January. A form that needs a signature on 6 January often does not get one. If you are working to 15 January, you are working to a date that will move without telling you.

What happens if I do not submit?

Fines start at R1.5 million or 2% of annual turnover, whichever is greater, and escalate for repeat non compliance. You also cannot obtain a Section 53 compliance certificate, which means you cannot contract with the state.

Does this replace the Department's EE Online system?

No, and it is not meant to. EquityFlowSA is where the analysis and the planning are done and where the completed EEA2 and EEA4 are produced. Submission still happens on the Department's EE Online portal, and you upload there yourself. Nothing is filed with the Department on your behalf.

Is my employee data safe?

No employee names and no identity numbers are held anywhere in the system, only the headcounts and remuneration figures the EEA forms require. Data is encrypted in transit, and accounts are separated by the database itself, so one account cannot read another. Client organisations are kept entirely separate from one another. The Privacy Policy sets out where data is hosted, how long it is kept, and who can see it.

I am a consultant filing for several companies, does that work?

Yes. Each client organisation is a separate file with its own data and its own report, managed from one login. Practice holds five files, Consultancy fifteen, with more available at R95 each per month.

Can I try it before paying?

Yes, and there is no clock on it. Every account gets a complete worked demo client, free for as long as you like, with no card required. Walk the whole process on it, come back to it in three months, use it to train someone. You subscribe only when you want to open a client file of your own, and nothing you did in the demo is lost when you do.
